Voice API Terms

1. About these terms

These terms cover the Vibe Typer Voice API: the /v1 HTTP API, the API keys we issue for it, and the <vibe-voice> element when it calls the API. The Voice API is operated by Abram Industries Pty Ltd (trading as Vibe Typer), an Australian company.

They add to our Terms of Service, which also apply to your account. Where the two differ, these terms win for the Voice API. By pressing Get API key, or by using an API key, you agree to them on behalf of yourself or the organisation you build for ("you").

The @vibetyper/voice package is open source under the MIT License. That license covers the package's code. These terms cover your use of the API it calls.

2. Your API key

  • Keep it secret. Your key belongs on your server only. Never put it in a website, a mobile app, a desktop app or a public repository.
  • You're responsible for its use. Every recording made with your key is billed to you, including recordings made by someone who obtained a key you leaked. Rotate a leaked key straight away from your billing portal.
  • One account per developer or organisation. Don't share keys between unrelated businesses, and don't create extra accounts to get around a limit.
  • We may revoke a key that appears to be compromised or misused. We'll tell you by email when we do.

3. Pricing and billing

  • Price. US$0.50 per hour of audio, billed by the second with no fixed fee. Magic Formatter is included.
  • Invoicing. Polar is our merchant of record. It invoices each month's usage at the end of the billing period and charges the card you added at checkout. Tax is added where it applies.
  • Small amounts. When a month's usage is below the smallest amount the card network can charge, Polar carries it forward and adds it to your next invoice.
  • Monthly limit. Every account starts with a limit of US$100 a month. We email you at 90% and at 100%. At the limit, new recordings are refused until your next billing period. A recording already under way when you reach the limit finishes and is billed. To raise your limit, email support@vibetyper.com.
  • Refunds. Usage charges are non-refundable, except where the law requires otherwise.
  • Failed payments. If a payment fails, new recordings are refused until the invoice is paid.
  • Price changes. We'll give you at least 30 days' notice by email before we change the price.

4. Cancelling

You can cancel at any time from your billing portal. New recordings stop as soon as you cancel. Usage up to that point is invoiced at the end of the billing period, and nothing is charged after that.

If you're a consumer in the EU or UK, you may withdraw within 14 days of subscribing by cancelling. You still owe for the usage you made before withdrawing, because you asked us to start providing the service straight away.

5. Your responsibilities to your users

You decide to record your users' voices, so you are responsible for doing so lawfully. In particular, you must:

  • Tell your users. Your privacy notice must say that voice input is processed by a third-party speech service. You may name Vibe Typer and link to this page.
  • Have a lawful basis. Get consent where the law requires it, including any consent needed to record a person.
  • Only record on a user's action. The element records only after the user presses the button. Don't build a way around that, and don't record anyone without their knowledge.
  • Protect children. Don't use the Voice API with users under 16 unless you meet the child privacy laws that apply to you, such as COPPA in the US and the GDPR's parental consent rules.
  • Send a pseudonymous user ID. The token route requires an ID for each of your users. Use your own internal ID, not an email address, name or phone number.
  • Check the output. Transcription can be wrong. Don't rely on it alone where a mistake could harm someone, for example in medical, legal or emergency use, without a person reviewing the text.

6. Acceptable use

You may not use the Voice API to:

  • Break any law, or record, transcribe or process content you have no right to
  • Get around monthly limits, rate limits, the one-recording token design or the browser-origin check
  • Resell or give raw API access to others as a standalone speech-to-text service
  • Collect transcripts to train or evaluate a competing speech recognition model
  • Test the security of the API or disrupt it for other customers, unless we have agreed to it in writing
  • Send audio that isn't speech intended for transcription

Usage should come from real people using your product. We may review usage that looks automated or unusual, slow it down, or suspend the key while we ask you about it.

7. How we handle your users' data

For audio and text sent through the Voice API, you are the controller and we act as your processor. We process that data only to provide the Voice API to you.

7.1 What we process and keep

Data What happens to it
Audio Held in memory while it is transcribed, then discarded. Never stored.
Transcripts Returned to your user's browser or your server, then discarded. Never stored.
Recording record For each recording we keep its ID, your account, the key used, the user ID your server sent, its status, its billable seconds and timestamps. We use it to bill you, enforce limits and prevent abuse.
Request metadata IP address, user agent and request details are used for rate limiting and appear in short-lived security and error logs.

We keep recording records while your account is open, and afterwards for as long as we need them for billing, tax and legal obligations.

We never use your users' audio or transcripts to train models, and we require our inference providers not to retain or train on them.

7.2 Subprocessors

We use other companies to help provide the Voice API, for hosting, the database, speech recognition, billing and email. You authorise us to use them. Each is bound by data protection terms at least as protective as these. The current list is in our data processing agreement, which you can request by emailing support@vibetyper.com with "DPA" in the subject line.

We'll email you before we add or replace a subprocessor that handles your users' audio or text. If you object on reasonable data protection grounds, tell us within 14 days. If we can't address the objection, you may cancel.

7.3 Transfers and agreements

Data may be processed outside your users' country, including in the United States, under the safeguards described in our Privacy Policy and our data processing agreement.

7.4 Requests from your users

Because we don't store audio or transcripts, there is usually nothing of your users' content for us to return or delete. If a user asks you to delete their recording records, email us their user ID and we'll delete them unless we must keep them for billing or legal reasons.

8. Availability and changes

We work to keep the Voice API fast and available, but we don't offer a service level agreement. We may change the API. If a change would break a working integration, we'll email you at least 30 days before it takes effect, unless we need to act sooner for security or legal reasons.

9. Suspension and ending

We may suspend or end your access if you break these terms, fail to pay, or put the service or other customers at risk. Where we can, we'll tell you first and give you a chance to fix the problem. You can stop using the API and cancel at any time.

10. Liability

Sections 10 and 11 of our Terms of Service apply to the Voice API. Our total liability for the Voice API is limited to the amount you paid for it in the 12 months before the claim.

11. Changes to these terms

We may update these terms. We'll email you about material changes at least 30 days before they take effect. Using the API after that date means you accept the updated terms.
